Terms of Service
Version: 1.0
These terms are an agreement between you and Hyzeer ("Hyzeer", "we", "us"), who runs the Hyzeer app at app.hyzeer.com, the Hyzeer Android app, the website hyzeer.com and the lost-disc label pages. Our details are in Company Details.
By creating an account you accept these terms and our Privacy Policy. If you buy something, the Terms of Sale also apply.
1. Who can use Hyzeer
- You must be at least 16 years old to create an account.
- One account per person, and per email address. You are responsible for what happens in your account and for keeping access to your email safe: Hyzeer has no passwords, so whoever can read your email can log in.
- You don't need an account to report a found disc through a label page. These terms apply to that use too, except the parts about accounts.
2. What Hyzeer offers
Hyzeer lets you score disc golf games alone or with others, keep a list of your discs, print labels for them, and get messages when someone finds a lost disc. It also has public courses, public games, achievements and banners.
- Hyzeer is free to use. Some cosmetic extras can be bought (see the Terms of Sale).
- We may add, change or remove features. If we remove a feature you paid for, the Terms of Sale say what happens.
- We try to keep Hyzeer available at all times, but we can't promise it will never be down or never lose data. The app keeps games on your phone when you have no signal and sends them when you are online again.
3. Your content
"Your content" is what you add to Hyzeer: your display name, games, scores and throws, discs and notes, course changes and course photos, found-disc messages, and reports.
- You keep your rights to your content.
- You let us use it to run Hyzeer: you give us a non-exclusive, worldwide, free licence to store, copy, show and adapt your content as needed to run and improve Hyzeer, and to show it to the people your privacy settings allow.
- Course information and course photos are shared. Course changes and photos you add become part of the public course page and can be changed by others. We may keep them after you delete your account; they are then shown as "Added by a deleted player". By adding a photo you confirm that you took it or may share it, and that it shows no people who can be recognised without their consent.
- Finished games are shared with the other players. If you delete your account, your scores stay in finished games so other players' results don't change, but your name is replaced with "Deleted player" (see Delete Your Account).
4. Hyzeer's content
The Hyzeer app, website, name, logo, label designs, banner items, achievements and texts belong to us or to those who license them to us. Using Hyzeer gives you no rights to them, except to use Hyzeer as these terms allow.
- You may not copy, sell or reuse them, or use the Hyzeer name or logo, without our written permission. Ask at support@hyzeer.com.
- Banner items you buy or earn give you the right to show them on your banner, not to use them anywhere else.
- You may use our public API as described at hyzeer.com/developers, and print labels for your own discs.
- Hyzeer uses open-source software under its own licences, which these terms don't limit.
5. Rules
You must follow the Community Guidelines. In short, you may not:
- use names, photos or messages that are offensive, hateful, sexual, threatening or that break someone else's rights;
- harass other players, or use found-disc messages for anything other than returning a disc;
- send spam, or try to get around the limits on messages and reports;
- enter false scores in public games or games of others to mislead;
- try to get into accounts or data that are not yours, attack, overload or scrape the service, or reverse engineer it beyond what the law allows;
- use Hyzeer for anything illegal.
6. Labels
- A label links a disc to your account. Whoever scans it can send you a message; they never see your name or contact details.
- You decide when to deactivate a label. Deactivate it before you sell or give away a disc.
- We don't guarantee that a lost disc will be found or returned, or that the finder's information is correct.
7. Moderation, blocking and ending your account
- We may remove content or rename a display name that breaks these terms or the Community Guidelines, and we tell you why (see Community Guidelines).
- We may block an account for serious or repeated breaches. A blocked player can still get their data and delete their account through support.
- You can delete your account at any time: Me → Delete account. See Delete Your Account.
8. Changes to these terms
When we change these terms we publish a new version here. If the change matters to you, the app shows a summary and asks you to accept the new version the next time you open it online. Until you do, you can still download your data, delete your account, log out and get help. Small changes that don't affect you, such as fixing typos, don't need to be accepted.
9. Liability
- Hyzeer is provided as it is. As far as the law allows, we are not liable for indirect damage, lost discs, or loss of data you could have exported.
- Nothing in these terms limits liability that can't be limited by law, such as for damage caused intentionally or by gross negligence, or your rights as a consumer.
If you have a complaint, write to us first: support@hyzeer.com. EU consumers can also use an out-of-court dispute resolution body.
